The property owner's duty

Florida property owners must keep their premises reasonably safe and warn of hidden dangers they know about, or should know about.

The level of duty depends on why you were there: invited customers receive the highest protection.

Proving notice

The key question is usually whether the owner knew, or should have known, about the hazard and failed to fix it. A spill that sat for an hour is very different from one that happened seconds before you fell.

What to do after a fall

Report the incident, photograph the hazard immediately, and get the names of any employees and witnesses. Conditions are often cleaned up within minutes.
